SHELTON, Dlreotor <br />July 22, 1987 <br />Mr. Robert Lobato <br />607 North Chautauqua <br />Sedan, Kansas 67361 <br />Re: Blue Flame Coal Mine - File No. C-81-053 <br />Dear Mr. Lobato: <br />On January 23, 1987, you spoke with Mr. Michael Savage on the telephone about <br />the status of this mine. As addressed in our letter of February 4, 1987, we <br />agreed to your request to delay action on this application for up to six <br />months. This requested six month period has expired. <br />Since the telephone conversations and letters of late January and early <br />February 1987, we have not had any further contact. Because of the lack of <br />activity in obtaining the permit for this site, the Division respectfully <br />requests that you withdraw the permit application. <br />The withdrawal of this application will not preclude the removal of coal by <br />your father, Mr. Fidel Lobato, for personal usage. As addressed in <br />Rule 1.05:1(1) and in CRS 34-33-129(1)(a), <br />"The provisions of this article shall not apply to. ... the extraction of <br />coal by a landowner for his own noncommercial use from land owned or <br />leased by him." <br />If coal is to be removed for more than the personal usage of your father, then <br />a permit from this office is required. <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel.
