A description of the documents upon which The Rockcastle Company bases its <br />' legal right to enter and begin mining is given on pages I-7 to 1-9a of the <br />permit application. The "Prink Lease" shows that the coal lease covers <br />' the WZE%, of Section 29. Checking the Mining Plan Map confirms that the <br />limits of Pit 8 are within the Prink lease. Further, leases and addenda <br />~, to leases with the surface owner, Bogle Farms, allow The Rockcastle Company <br />~ ~ to use all of Section 29 except the NW;NW',. For purposes of this present <br />permit term, this is a moot point since The Rockcastle Company will not <br />' mine Pits 1 or 8 during the existing permit term. <br />II. No action required by The Rockcastle Company. <br />' V. 1. The Rockcastle Company will coordinate with the landowner regarding filing <br />of water rights for the proposed livestock watering ponds. <br />' 2. The Rockcastle Company plans to leave four ponds as permanent stock watering <br /> ponds: Ponds '2`,"'3,"4 & 5. Pond 1 will be removed in the near future (possibly <br />' as early as summer of 1984). There is no Pond 6 - Pond 5 collects runoff <br /> from Pit 6. Pits 7 & 8 will not be constructed during this permit term and <br /> thus Ponds 7 & 8 will not exist. <br /> Ponds 2 & 3 were constructed under the original permit issued in 1978. <br />No <br />rovi <br />i <br /> p <br />s <br />ons were made to backfill either of these ponds (no excess <br /> material is available <br />for,backfilling). Since these are in~situ <br />ponds <br /> /~ <br />` fL _ <br />._, <br />~a^~able in their present condition, no additional work will be <br /> done to them prior to abandonment. <br /> <br /> <br /> Ponds 4 & 5 are also in-situ ponds.
