Damrau <br />Getty Uil Company <br />23385 Routt County Road 33 <br />Oak Creek, Colorado 80467 <br />RE: Energy Mine No. 3 Reclamation Plan, File No. C-036-81 <br />Uear Mr. Damrau: <br />The Division has received the reclamation plan for Energy Mine No. 3. <br />Information contained in the plan will be considered as additional <br />material to File No. C-036-81,. We do not think it's necessary to <br />consider this information as a separate permit and therefore no <br />publication is necessary at this time. As we discussed yesterday, <br />however, it is my understanding that Colorado Yampa Coal Company will <br />submit a new application for reclamation only in August. The new <br />application will include everything but the tipple, haul road and office <br />area. When a new application is submitted, it will be necessary to <br />publish. <br />Review of Eneryy No. 3 is scheduled to occur in August. At that time we <br />will respond to the adequacy of the plan, or preforably review the <br />detailed information that will be submitted. Since the reclamation plan <br />submitted last week is of a very general nature it does not make sense to <br />review the plan until we have more detailed information. <br />Besides the review process, the Division is concerned about reclamation <br />progress at Mine No. 3. Last year, Colorado Yampa Coal Company had <br />I committed to completing topsoil redistribution on all surface mine areas <br />in the spring of 1983. In a meeting of June 10, ]983 Colorado Yampa Coal <br />Company claimed that the equipment was tied up at Eckman Park and only <br />~ the overburden stockpile area will be topsoiled and seeded this year. <br />This is only a small portion of the total area to be reclaimed at the <br />Energy Mine No. 3. Previously, the Division felt that since the surface <br />~ mine would be entirely reclaimed by the spring of 1983, a new sediment <br />control system in compliance with Rule 4.U5 may not be necessary. With <br />the extension proposed by Colorado Yampa Coal Company for reclamation of <br />the surface mine areas, a sediment control system designed in compliance <br />with Rule 4.U5 is necessary.
