Permit CO-0012 <br />• • Page 5 of 13 <br />Attachment 1 <br />Special Stipulations <br />The term "regulatory authority" means the Colorado <br />Division (CMLRD) and the Department of the Interior, <br />specified in the Colorado cooperative agreement. <br />Mined Land Reclamation <br />OSM, unless otherwise <br />1. If during the course of mining operations previously unidentified cultural <br />resources are discovered the applicant shall ensure that the site(s) is not <br />disturbed and shall notify the regulatory authority. The operator shall <br />ensure that the resource(s) is properly evaluated in terms of National Regis- <br />ter Eligibility Criteria (36 CFR 60.6). Should a resource be founr~ eligible <br />for Listing in consultation with the regulatory authority, the land managing <br />agency Cif the site is located on federal lands) and the SHPO, the operator <br />shall confer with and obtain the approval of these agencies concerning the <br />development and implementation of mitigation measures. <br />2. The applicant must, within one yeaz of the permit issuing, submit a plan <br />to the Regulatory Authority for restoring the essential hydrologic functions <br />of the Stevens Gulch and North Fork of the Gunnison alluvial valley floors. <br />This plan shall identify the essential hydrologic functions of these two <br />alluvial valley Eloors and must show in adequate detail how the essential <br />hydrologic functions will be restored. <br />3. The operator shall submit to the Regulatory Authority an annual report of <br />inflows, discharges, and consumption of water within the mine. This report is <br />to include a mine workings map showing the location and quantity of inflows; a <br />table keyed to the mine map which shall contain the source (i.e., fault, frac- <br />tures, etc.), quantity, duration and quality (i.e., pH, electro-conductivity <br />and temperature) of all measurable inflows; a table containing records of <br />water imported for use within the mine; a discussion of the water balance <br />within the mine, and finally, a projection of hydrologic impacts of mining in <br />the upcoming year. <br />4. All springs in the 5-year permit area and adjacent area (those in Sections <br />18 and 19, T23S. R91W, and Section 24, T13S, R29W) shall be monitored for dis- <br />charge and water quality (i.e., pH, electro-conductivity and temperature) on a <br />quarterly basis as weather permits. The data gathered from the monitoring <br />shall be submitted to the Regulatory Authority quarterly. <br />5. The operator shall begin monitoring the alluvium of the Stevens Gulch well <br />field. The monitoring well should be monitored monthly for water levels and <br />quarterly Eor water chemistry. The data gathered from the welt shall be sub- <br />mitted to the Regulatory Authority quarterly. <br />6. The operator shall install and begin monitoring one monitoring well loca- <br />ted over the panel to be monitored Eor subsidence one year prior to mining <br />
