<br />~~ <br />~• <br />MEMORANDUM <br />T0: Assistant Secretary, Energy and Minerals <br />FROM: Director, Office of Surface Mining <br />SUBJECT: Recommendation for Approval of Orchard Valley Mining and <br />Reclamation Plan, Colorado Westmoreland Inc., Delta County, <br />Colorado (Federal Lease C-25079 and C-27432) <br />Pursuant to the Surface Mining Control and Reclamation Act (SMCRA) and the <br />Mineral Leasing Act, as amended, I am advising you that OSM is prepared to <br />approve a permit for the Orchard Valley Mine. My decision to approve Colorado <br />Westmoreland Inc.'s application for a permit under the Federal Lands Program <br />is based on the applicant's complete permit application with the attached <br />stipulations, public participation, the review of the application by OSM and <br />the State as required by 30 CFR Chapter VII, Subchapter D and the approved <br />Colorado State Program, and compliance with the National Environmental policy <br />Act. The Secretary may approve a mining plan for Federal lands under Sections <br />2(a), (2)(b), and (2)(a)C3) of the Mineral Leasing Act, as amended, if the <br />proposed operations will be in compliance with all applicable laws and <br />regulations. <br />I recommend that the mining plan be approved. <br />Attachment <br />I approve: <br />Assistant Secretary, Energy and Minerals <br />Date <br />
