Please also state, pursuant to Section <br />• 2.07.6(2)(d)(iii)(B) of the Regulations, whether the proposed life of mine affected area will <br />exist on lands within 300 feet measured horizontally of any public building [Section <br />1.04(101)], school, church, community building [Section 1.04(27)], institutional building or <br />public park (Section 1.04(103)), or on lands within 100 feet measured horizontally of a <br />cemetery. <br />Reggonse <br />The following text has been added to the end of the second pazagraph of Section 2.03.7 on <br />revised page 2.03-7 "public building, school, church, community building, institutional <br />building, public park or on lands within 100 feet of a cemetary." <br />27. Pursuant to Sections 2.03.7 and 2.07.6(2)(d)(iv) ofthe Regulations, please state whether the <br />proposed life of mine affected area will exist on lands within 100 feet, measured horizontally <br />of the outside right-of--way line of any public road, except where mine access roads or haul <br />roads join such right-of--way line or where the relocation or closure of any public road is <br />proposed. <br />Response <br />No mining activities will occur within 100 feet of Highway 12, the only public road neaz the <br />• mine site. As shown on the Mine Plan (Map 2.05.3-1), the closest facility to Highway 12 <br />will be the Coal Loadout Facility at a distance of 1,900 feet from the highway. <br />28. With regard to other licenses and permits (application page 2.03-7 and Table 2.03.10-1), will <br />an explosives permit also be required? <br />The requirement for an explosives permit has been added to Table 2.03.10- l on revised page <br />2.03-8. <br />Rule 2.04.3 Site Description and Land Use Information. <br />29. The Premine Land Use Map 2.04.3-i shows land use on adjacent lands to the North of the <br />Permit area as being "Cropland" and "Hay Meadow". Cropland, defined by Rule 1.04(31) <br />"means land used for the production of adapted crops for harvest, alone or in a rotation with <br />grasses and legumes, and includes row crops, small grain crops, hay crops, nursery crops, <br />orchard crops, and other similaz specialty crops." While much of the adjacent land does fall <br />under the definition of "Cropland", the small community, including a Jr./Sr. High School, <br />located immediately North of the permit area, would not be considered cropland. The Map <br />should reflect that a portion of the adjacent azea is residential. Please correct the Pre-mine <br />• Land-use map to include Residential land use. This correction should also be made on the <br />pre-mine land use description found on page 2.04-1. <br />8 <br />
