• Bruce Addington is the only person on the list who had previously owned or controlled a
surface coal mining and reclamation operation, prior to December 23, 1996. The information
found in Exhibit 1 describes Mr. Addington's prior involvement in coal mining operations.
However, the entire slate of "persons", with the exception of Lorencito Coal Company, is in
the process of acquiring the pemrit for the New Elk Mine. This property currently has
CDMG permit number C-81-012, and MSHA Identification Number OS-04461. This
information has been added to revised page 2.03-4.

No other "persons" have been owners or controllers of other surface coal mining and
reclamation operations, as stated in the response to question 18.

A.P. Maxwell and Taiheyo (U.S.A.) as Picketwire Processing, LLC.
