With respect to the <br />alleged telephone conversations between Vance Mills and Henry <br />Rem, it is now apparent that no agreement was reached with <br />respecx to necessary material terms and, as a result, no spe- <br />cifically enforceable legal right to continue ongoing mining <br />operations exists. This is conclusively demonstrated by the <br />sworn testimony of both Mr. Mills and Mr. Quinn. Even Mr. <br />Wiggins, who is himself an attorney, does not claim that these <br />alleged conversations give rise to rights beyond those afforded <br />through the equitable doctrine of estoppel, which at most would <br />only justify defendants' past conduct.
