Walther <br />Eaecmive Dbcaa <br />Michael B Long <br />Division Director <br />Effective May 10, 2001, the Colorado Division of Minerals and Geology (DMG) has received <br />information sufficient to conditionally reactivate the Lorencito Coal Company, LLC Permit No. <br />C-96-084. Specifically, the DMG now has two letters of intent indicating ongoing and substantial <br />negotiations between Lorencito Coal Company, LLC and the owners of the coal and surface rights <br />within the permit area for Permit No. C-96-084. These letters of intent aze dated April 30, 2001 and <br />May 9, 2001. <br />We note that the May 9, 2001 letter of intent limits reference to a 3,000 acre azea of land. We also <br />note that both the April 30, 2001 and May 7, 2001 letters will expire if the lease agreements <br />referenced in the respective letters of intent are not executed by the 5:00 p.m. MST on June 1, 200L. <br />Pemtit C-96-084 is therefore reactivated effective May 10, 2001 with the following conditions: <br />-With this permit reactivation, the deadline for commencement of operations described in <br />Rule 2.01.5(2), shall be May 10, 2002. If operations do not commence on or before May 10, <br />2002, then the permit shall expire on May !0, 2002. <br />-If operations commence on or before May 10, 2002, then the permit shall expire November <br />7, 2002, unless the permit is renewed in accordance with 2.08.5. November 7, 2002 is the <br />original permit term expiration date. <br />The Permit Revision application (PR-O1) recently provided to the DMG is hereby considered <br />formally submitted effective May 10, 2001. The ten day application completeness review period <br />shall also commence on May 11, 2001. A completeness determination will be provided on or <br />before May 21, 2001. We understand that surface and mineral lease negotiations are ongoing, and <br />that final agreements will occur in the near future. We also understand that the letters of intent <br />
