After recent discussions with members of the Colorado <br />Mined Land Reclamation Division, Colorado American has con- <br />chided that it should petition the Board to eliminate from the <br />permitted area of Permit No. C-048-81 the N~SE~ and S~NE~ of <br />Section 15, Township 31 South, Range 65 West, 6th P.M. in order <br />that Colorado American may apply for a new coal mining permit <br />on that tract. Colorado American is willing to post a bond on <br />behalf of the tract and assume the liability for the above- <br />described disburbances on the tract. <br />REQUESTED RELIEF: <br />Colorado American hereby requests the Colorado Mined Land <br />Reclamation Board to issue a declaratory order pursuant to <br />C.R.S. §24-4-105 (1973) and Rule 1.14, 2 C.C.R. 407-2 <br />eliminating the N~SE~ and S~NE~ of Section 15, Township 31 <br />South, Range 65 West, 6th P.M. from Permit No. C-048-81. The <br />elimination of the tract from Permit No. C-048-81 would allow <br />the Division to process a new coal mining permit application on <br />the tract to be submitted by Colorado American. Colorado Amer- <br />ican would post a bond for the tract and would assume <br />-3- <br />
