The Petitioner is not a permittee pursuant to the <br />Colorado Surface Coal Mining Reclamation Act with respect to <br />the lands which are the subject matter of this Petition. <br />STATUTORY BASIS: <br />This Petition is based on C.R.S. §24-4-105 (1984 Supp.) <br />and Rule 1.14, 2 C.C.R. 407-2, and relates to C.R.S. <br />§§34-33-109(5), 34-33-115 and 34-33-116 (1984 Supp.) and <br />Rule 2.08, 2 C.C.R. 407-2. <br />STATEMENT OF FACTS: <br />The Petitioner, Colorado American, has entered into a let- <br />ter of intent with, and is presently negotiating a formal <br />agreement with, The Victor-American Fuel Company ("Victor Amer- <br />ican") and American Carbo-Minerals Corp. ("American Carbo"), <br />the owners of the coal in the N'~SE~q and S~,NE; of Section 15, <br />Township 31 South, Range 65 West, 6th P.M.
