DANIELSON, DEPUTY STATE ENGINEER
SUBJECT: BEAR COAL COMPANY - BEAR MINE, GUNNISON COUNTY, APPLICATION
FOR MINING AND RECLAMATION PERMIT
As requested by your office, we have reviewed the application for an under-
ground coal mine near Somerset. The applicant has sufficient surface water
rights to physically provide the 5.4 million gallons per year required for
mining and adequate water for reclamation. Exhibit G states, however, that
"this flow is supplied by water encountered in Ininin9 which is collected in
underground sumps and supplemented by surface water. ." In order to
legally use this underground water and to prevent injury to adjudicated
water rights in the over-appropriated North Fork Basin, the applicant must
obtain a well permit for this underground water or show that it is being
used in accordance with a decreed water right.
JAD/SSH/pjl
Q .,~0
ris A.
