DANIELSON, DEPUTY STATE ENGINEER <br />SUBJECT: BEAR COAL COMPANY - BEAR MINE, GUNNISON COUNTY, APPLICATION <br />FOR MINING AND RECLAMATION PERMIT <br />As requested by your office, we have reviewed the application for an under- <br />ground coal mine near Somerset. The applicant has sufficient surface water <br />rights to physically provide the 5.4 million gallons per year required for <br />mining and adequate water for reclamation. Exhibit G states, however, that <br />"this flow is supplied by water encountered in Ininin9 which is collected in <br />underground sumps and supplemented by surface water. ." In order to <br />legally use this underground water and to prevent injury to adjudicated <br />water rights in the over-appropriated North Fork Basin, the applicant must <br />obtain a well permit for this underground water or show that it is being <br />used in accordance with a decreed water right. <br />JAD/SSH/pjl <br />Q .,~0 <br />ris A.
