White <br />Twin Pines Goal Company <br />1650 M Street <br />Penrose,.Golor--ado 81240 <br />/Re: Twin Pines~Adequacy <br />Dear Mr. White: <br />Review File No. C-058-83 <br />During our review of the Twin Pines' permit application, C-058-83, our <br />staff identified the following portions of the application that are <br />considered inadequate. Excluded from this list are the issues that were <br />resolved as a result of the January 9, 1983 completeness and adequacy <br />letter and also those issues being addressed by the Small Operators' <br />Assistance Program regarding geology and hydrology. <br />The Division is required by law to propose a decision as to whether an <br />operation should be permitted within 120-days after the filling of a <br />complete application unless the application is unusually complex or <br />controversial. This 12U-day date for Twin Pines will be September 9, <br />1983. Because of this time frame under which the Division must operate, <br />responses to adequacy issues from the applicant must be made in a timely <br />manner in order that they can be taken into account during the review. <br />The Decision suggests that Twin Pines respond to the adequacy issues <br />identified herein prior to August 15, 1983. <br />Also those issues from the January 9, 1983 adequacy letter which were not <br />previously addressed must also be addressed within the forementioned <br />timeframe. These issues include: a stablity evaluation of the worst-case <br />situation along the road, and underground development waste disposal plan <br />which satisfies the requirements of Rule 4.09.
