PURPOSE <br />The purpose of this submittal is to satisfy the requirements of Rule 2.08.4 <br />Revisions to a Permit, with respect to an incidental permit boundary revision <br />associated with design changes for regulated sedimentation control structures <br />t for the Energy Mine 3 tipple area within the presently approved Permit No. <br />76-16 boundary. The Colorado Yampa Coal Company believes that the requested <br />changes will have no effect on the performance bond requirements of Rule 3. <br />' OPERATIONAL PLAN <br />The Colorado Yampa Coal Company plans to construct sedimentation control <br />structures in accordance with the design changes submitted within this <br />application under Exhibit 1, Sedimentation Pond and Diversion Ditch Designs. <br />The location and extent of the planned structures are shown on Map TR1, <br />' Proposed Sedimentation Control Plan for Compliance with W.Q.C.D. The <br />activities planned to be conducted in the vicinity of the tipple 3 area, <br />including the planned sedimentation pond, are shown in greater detail on <br />t Map TR2, Plan View of Tipple Area for Compliance with C.W.Q.D. <br />The equipment to be utilized to construct the planned sedimentation control <br />' structures will include Fiat Allis 263B paddle-wheel scrapers, a Caterpillar <br />16G motorgrader, a Caterpillar 825 compactor, a Caterpillar 245 backhoe and <br />a Terex 72-71 front-end loader. <br />The revised sedimentation control design changes, herein submitted, necessitate <br />additional area to be added to the present permit boundary in order to <br />accommodate the planned sedimentation pond and a diversion ditch associated <br />' with the pond. The area to be added to the 76-16 permit boundary is shown <br />on all of the maps submitted with the application. The total acreage to <br />be added is 19.0 acres. The Colorado Yampa Coal Company is the legal <br />owner of record of the surface area subject to this technical revision <br />' application. No coal is planned to be mined from the area subject to this <br />technical revision application. <br />' ENVIRONMENTAL RESOURCES INFORMATION <br />Required environmental resources information associated with the above planned <br />' activities can be found in the appropriate sections of the Energy Mine 3 <br />Permit Application, CMLRD File No. C-036-81 and the mining and reclamation <br />plan of previously approved Permit 76-16 permit application. <br />' The planned activities will not preclude agricultural activities and will <br />not cause material damage to the Fish Creek alluvial valley floor as addressed <br />in pages 2.06-13 through 2.06-27 of the Energy Mine 3 Permit Application, <br />CMLRD File No. C-036-81. Map TR3, Fish Creek Stream-laid Deposits for <br />Compliance with W.Q.C.D., deliniates the stream-laid deposits of Fish Creek <br />in the area associated with this technical revision application. <br />1 <br /> <br />~' <br />
