Simpson, Assistant State Engineer~,~5^t- <br />SUBJECT: Water Issues Regarding the Proposed Twin Pines No. 2 Mine <br />This is to acknowledge receipt of your November 23, 1983 memo to our office. <br />The memo serves as a follow-up to the November 21, 1983 meeting between Ed <br />Bischoff, Dick Stenzel, Jim Hall, and you. In the memo, you asked questions <br />concerning the water impact of and the water rights requirements for the Twin <br />Pines No. 2 Mine. Following are our responses to each question that you posed: <br />1. The best way to quantify the physical supply of water available in <br />the Caldirola Mine is to conduct a pump test of the well. As you <br />know, there is some ambiguity as to what the Town of Coal Creek may <br />use the well water for under the provisions of Water Court Case No. <br />80CW93. <br />2. The stipulation set forth in your letter under question 2 would not <br />ensure compliance with all state water laws. The stipulation with <br />the underlined addition and marked deletion would require Twin Pines <br />to comply with water law concerning the use of water flowing into the <br />mine. <br />Stipulation <br />PRIOR TO THE USE OF MINE WATER FOR ANY F1I~~3t5ROHA&) MINING ACTIVITIES <br />OR DEWATERING OF MINE WATER, TWIN PINES OdAL COMPANY, INC., MUST <br />OBTAIN ALL STORAGE AND WELL PERMITS REQUIItED BY APPLICABLE STATE LAW. <br />3. We believe this stipulation should require that water be made avail- <br />able before the applicant Can begin mining in any area which would <br />affect the Caldirola Mine well. The stipulation should also require <br />that replacement water must be made available until the Caldirola <br />Mine well returns to its present Condition. <br />,'v <br />JE RIS A.
