Wathen <br />March 9, 1993 <br />Page 2 <br />impacts, which were not part of previous permitting <br />activities, are now identified as concerns and may result <br />in restrictions on HGTI's permit that were not placed on <br />the previous permit. We remind the Division that no <br />significant deviations in operations as conducted by the <br />previous owner are contemplated, with the exception of <br />proposed haul road HG2. The environmental assessments <br />and operational findings contained in reviews of the <br />previous permit application are directly applicable to <br />this application. Substantial information has been <br />provided to the Division which was not made available for <br />previous permitting decisions, and which should expedite <br />the current permitting decision. Peabody has made every <br />effort to be responsive to the concerns identified in the <br />PAR's, and trusts the Division will evaluate these <br />responses in view of the operational nature of this <br />facility. <br />If you have any questions, do not hesitate to contact me. <br />Sincerely, <br /> <br />Brian P.
