The MLRB conducted the hearing to determine if the proposed decision <br />to approve with stipulations Pittsburg and Midway's coal mining and reclamation <br />permit should become final. <br />R quorum of the MLRB was present during the entire hearing and participated in <br />deliberation and voting on the matter. h1r. Joseph Sullivan, Chairman of the <br />MLRB, presided. Other board members in attendance were Hamlet J. Barry, Sherman <br />~ /B1ach, Davis Holder, Margaret Winter and Larry Broion. <br />Pursuant to the authority vested in the Mined Land Reclamation Board by C.R.S. <br />1973, 34-32-119(5) and 2.07.9 of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining, the Board hereby maAes the following findings <br />of fact and conclusions of law. <br />i'i ndings of Fact <br />f <br />1. Pittsburg and Midway Coal Mining Company submitted an application For a <br />mining and reclamation permit (File C-OOZ-80) in December, 1980 which was found <br />to be complete on February 9, 1981. <br />2. A proposed decision was issued September 2, 1981 to approve the permit with <br />58 stipulations. <br />3. After the proposed decision was issued, the Division for good cause modified <br />the proposed decision and proposed a joint settlement agreement to reflect those <br />modifications. <br />4. Pittsburg and Midway Coal Mining Company and the Division arrived at a joint <br />settlement agreement on October 27, 198I, which included: <br />a. Additional information had been provided which fulfilled 37 of the <br />stipulations, <br />b. Ten stipulations were to remain as ~oritten, and <br /> <br /> <br />
