LOng <br />Drvrsion DueUOr <br />Ron Nearson phoned the office this morning and we discussed his <br />concerns regarding our proposed issuance of the H-G Loadout permit. <br />Mr. Nearson said he is not requesting a formal hearing'. He wanted <br />DMG to be aware of his concerns. We discussed each of his four <br />concerns. <br />I told him that noise issues did not fall under DMG's jurisdiction <br />and that this would be a county issue, related to the special use <br />permit which was recently issued. <br />I briefly described air emission permits to him and told him there <br />was somewhat overlapping jurisdiction between DMG and DOH, since <br />the emission permit is included in the mine permit. I said if he <br />had any problems in this area, to contact DMG or DOH. <br />I told him the issue of trains crossing the county road was a <br />county issue. <br />I told him trash disposal was addressed in the mine permit and that <br />we regulated that. I told him Peabody had not yet designated any <br />noncoal waste disposal area but, that they probably would soon. He <br />said he was not happy with past trash disposal or dust control. I <br />pointed out to him that Peabody was a new operator. He was not <br />aware that ownership of the Loadout was changing. <br />Mr. Nearson thanked me for answering his questions and seemed to be <br />satisfied that we had addressed his concerns. <br />c:\wp51\51893 <br />
