Savage $AVA-(~~ <br />SUBJECT: OSM Comments on Snowmass Coal Company Preliminary Adequacy Letter <br />Our File No. C-025-81 , <br />I find that I cannot concur with the comments provided by OSP1 in the sections <br />on Fish and Wildlife Resources Information (2.04.11) and Mitigation of Impacts <br />for Fish and 4ildlife (2.05.6(2)). RElative to OSr1 comments on Item 4 (2.04.11). <br />The Division has not endorsed the wholesale sampling of fish and wildlife <br />populations for baseline information without a preliminary specific concern <br />being identified beforehand, by the applicant, the U.S. Fish and Wildlife <br />Service, the B.L.M., or the Colorado Division of Wildlife. The material <br />requested in OSM comment No. 6 and No. 7 will be evident from '1041' maps <br />and 'Latalon9' information that Snowmass should obtain relative to MLR <br />comment No. 2 - relative to OSM comments on Fish and Wildlife Mitigation. <br />Plans 2.05.6(2) the regulatory authorities will be able to make a determination <br />of adverse effects from baseline information obtained from Colorado Division <br />of lildlife. <br />Relative to comment No. 5 (2.05.6) OSM should note that Snowmass has proposed <br />a fish and wildlife plan, and that any program for mitigation will not be <br />approved until findings have been made and a permit issued, <br />mab <br />
