Long <br />Division Director <br />The Division of Minerals and Geology (DMG) requests a waiver of fiscal rule Chapter 3, <br />Section 1.20 requiring the use of a contract for all engineering services. DMG is planning <br />to acquire the services of an engineer under the Small Operator's assistance program. The <br />anticipated cost is less than $10,000. <br />The Small Operator Assistance Program (SOAP) is set forth in §34-33-112 and offers <br />administrative, educational, and administrative assistance to the small coal operators in the <br />State of Colorado. The Act defines a small operator as an operator of a mine in which the <br />probable total annual production will not exceed one hundred thousand tons. The operator <br />of the O.C. #2 coal mine has requested that we provide services to assist him in providing <br />additional necessary technical and administrative assistance in preparation of a revision to <br />the permit. The revision will be reviewed and approved or denied by DMG personnel. <br />The work to be accomplished under this project includes developing a topographic map and <br />a post-mining topographic map of the site, developing a hydrologic reclamation plan, <br />designing a backfilling and grading plan to meet stability requirements and developing cross- <br />sections to compare the pre-mining, current and post-mining topography. <br />as professional liability insurance will be required. <br />The DMG would prefer to use a Purchase Order Contract due to the low dollar amount of <br />the project. The Purchase Order will include similar conditions to that of a contract, but <br />will not use the Special Provisions required by a contract.
