I have been informed by my staff that your legal personnel may have
some reservations about the wording of the stipulations we submitted
for the Energy Fuels lease modification. Sde do feel that a study of
elk behavior constitutes a mi[i~atory measure within the framework of
Unsuitability Criterion 15, but we could enter into a cooperative agree-
ment with Energy Fuels to accomplish the study and execution of the
agreement could be the stipulation.
:ldditionally, we feel the fell~~:ing should be included as lease stipula-
tions:
1. The disturbed area must be reclaimed with Aspen and shrub species
present now on the site.
2. The site must be reclai^ed as contemporaneously with mining as
possi'~le.
3. A pll~-sical buffer zone of -fifty feet from the edge of the hill
must be left undisturbed.
As I have said, if you feel t}ie Bureau cannot require the proposed
elk stud~• as a stipulation, s;e can probably work this out as a coopera-
tive r.•crrent• lio;never, we fael we are looking at a much bigger "pic-
ture"L:lia:t just the elk utilitin the Energy Fuels lease. The answers
we get fr:~ this study will en:~hle us to predict impacts on all the
State's clk herds and .suggest -:iti~ation on future leases.
