Additional comments concerning ground water monitoring <br />will be provided later. In Exhibit G the applicant states that he has filed <br />for a well permit to use water generated in the mine. They filed for the <br />permit in October of 1979, however, the Ground Water Section of our office <br />denied their application on the basis that the mine is located in an over- <br />appropriated basin and any use of tributary ground water without a plan for <br />augmentation would injure existing water rights in the Fork Tongue Creek basin. <br />The applicant also mentions on page G-4 of the report that a system may be <br />developed to use runoff irrigation water from the property north of the mine to <br />back up the underground water. In order to use the runoff irrigation water, <br />the applicant would have to obtain water rights for the water and since the <br />basin is over-appropriated, the applicant would have to provide augmentation <br />water for the consumptive uses associated with the mine uses of the water. <br />It would appear from the information provided that the proposed sediment dam <br />will not exceed 10 feet in height from the original streambed to the bottom of <br />the spillway and, therefore, the plans and specifications will not have to be <br />submitted to this offioe for approval. <br />Until the applicant can obtain water rights In the Fork Tongue Creek basin to <br />provide for a plan for augmentation, the applicant will not be able to obtain <br />
