1,796,500 yd3 of overburden at the end of year four which will need to <br />be re-handled to backfill the pit. The applicant should provide an <br />estimated cos[ per cubic yard for moving this material. <br />d) Grading costs should be given in terms of cost per acre. <br />e) The 50t/yd3 cost of replacing topsoil seems low. Can the applicant <br />justify this figure? Seeding and fertilizing costs also seem low. <br />f) What areas are included in the 7.7 acres of moderate disturbance <br />specified in table three? <br />g) Several items have not been included in the cost analysis provided. <br />These include: <br />1. The cost of removing the office and shop. <br />2. The cos[ of reclaiming the access road. <br />3- The restoration of Mann Draw. <br />4. The removal and regrading of sediment ponds. <br />X. Local Government Approval <br />A letter demonstrating that this operation has local government approval must <br />be submitted. <br />XI. Source of Legal Right to Enter <br />The document which was submitted demonstrates only that Flatiron Paving Co. <br />has the legal right to enter from the surface owner. The applicant must also <br />demonstrate that legal authorization to mine coal has been obtained from the <br />mineral owners. Response to the Federal Interim Regulations <br />Most comments concerning the interim regulation submittal have already been <br />covered. These comments will not be repeated. I will leave it to the appli- <br />cant to make necessary charges in this section to insure that i[ is consistant <br />with the body of the application. <br />A few points remain, however: <br />715.11 (b) This section refers to your approved plan as well as permits <br />and liscenses. <br />715.12 (e) Blasting area signs must also explain warning and all-clear <br />signals. <br />715.14 (f) Overburden on the Bourg Coal property does not meet either the <br />thick or the thin overburden criteria. <br />For the mine as a whole, the initial volume (coal + bank yards of overburden) <br />is 6470.4 x 103 yd3, The final volume (dump yards of overburden) is 6188.5 <br />x 103 yd3. The ratio of final thickness to initial thickness is 0.96, hence <br />the overburden is likely neither thick nor thin. For this mine, in order to <br />meet the thick overburden criteria, a bulking factor of over 1.5 would be <br />necessary. <br />715.14 (j) Portions of the saline and sodic soils on the property may <br />well be considered "toxic" and require treatment according to this section. <br />More specific information concerning this material is necessary. <br />(~) <br />
