The applicant should provide an estimated cos[ per cubic yard for moving this material. d) Grading costs should be given in terms of cost per acre. e) The 50t/yd3 cost of replacing topsoil seems low. Can the applicant justify this figure? Seeding and fertilizing costs also seem low. f) What areas are included in the 7.7 acres of moderate disturbance specified in table three? g) Several items have not been included in the cost analysis provided. These include: 1. The cost of removing the office and shop. 2. The cos[ of reclaiming the access road. 3- The restoration of Mann Draw. 4. The removal and regrading of sediment ponds. X. Local Government Approval A letter demonstrating that this operation has local government approval must be submitted. XI. Source of Legal Right to Enter The document which was submitted demonstrates only that Flatiron Paving Co. has the legal right to enter from the surface owner. The applicant must also demonstrate that legal authorization to mine coal has been obtained from the mineral owners. Response to the Federal Interim Regulations Most comments concerning the interim regulation submittal have already been covered. These comments will not be repeated. I will leave it to the appli- cant to make necessary charges in this section to insure that i[ is consistant with the body of the application. A few points remain, however: 715.11 (b) This section refers to your approved plan as well as permits and liscenses. 715.12 (e) Blasting area signs must also explain warning and all-clear signals. 715.14 (f) Overburden on the Bourg Coal property does not meet either the thick or the thin overburden criteria. For the mine as a whole, the initial volume (coal + bank yards of overburden) is 6470.4 x 103 yd3, The final volume (dump yards of overburden) is 6188.5 x 103 yd3. The ratio of final thickness to initial thickness is 0.96, hence the overburden is likely neither thick nor thin. For this mine, in order to meet the thick overburden criteria, a bulking factor of over 1.5 would be necessary. 715.14 (j) Portions of the saline and sodic soils on the property may well be considered "toxic" and require treatment according to this section. More specific information concerning this material is necessary. (~)
