Dept. of Natural Resources <br />This letter is written in response to our recent telephone conversation <br />regarding some confusion surrounding the permit area for our recently <br />approved Sediment Pond #5. That approval contained a stipulation <br />requiring Dorchester to revise its permit boundaries to include the pond <br />structures. However, as Dorchester has attempted to comply with the <br />stipulation, procedural difficulties within the CMLR system appear to <br />have thwarted our efforts. <br />The root of these procedural difficulties lies in the fact that the pond <br />is located within the current GEC permit boundary. To be candid, we <br />had foreseen potential procedural issues as we prepared the original <br />submission for Pond #5. It is for this reason that we attempted to be <br />quite specific regarding the obligations we were to incur in the approval <br />for the pond. These obligations include the responsibility for the initial <br />design, approval, construction, ongoing inspections, monitoring, and main- <br />tenance, reclamation and bonding; in short, all of the obligations normally <br />associated with the installation of a sediment pond. <br />We feel that these obligations are fully enforceable by CMLR as terms of <br />a permit approval.
