Dear Pat:
Enclosed is a copy of the combined review notes which are the result of the
coordinated review by OSh1 and Colorado MLRD.
As we have discussed previously, in addition to the deficiencies identified
herein, MLRD will not issue permanent program approval until all required
vegetative baseline data have been collected and will not resume permanent
program re•/iew of the application until amending volumes V and Vl have
been incorporated into the body of the original four volume application.
Applications must be submitter] for review as a single, comprehensive, and
self-contained document from which extraneous consultants opinions/recommendations
and references to plans included in previous permits have been removed.
MLRD will consider this applica ti orT as an amendment to CWI's existing permit
under the interim regulatory program. Such an amendment would allow CWI
to begin mining into the new areas while the problems related to permanent
program permitting are resolved. A11 required materials should be submitted
within two months after the official publication of the new regulatory program
announcement in the Federal Register.
All materials except those identified as confidential in accordance with'
CRS 74-33-110(7), 34-3I-111(2) and 34-33-117(2) will he made readily available
for public review anr] must therefore be presented in the most lucid and
consistent fashion [ros.sible. CWI must commit itself to a single mining
and reclamation plan and plan Co replace all relevant application materials
as they are amended.
As discussed in the meeting of Octobet 16, 1980, between C[JI, OSM and Colorado
MLRD, the information requested herein is needed in order that OSM may
continue the environmental and technical analysis necessary for mine plan
approval.
