Banta, <br />Division Director <br />RE: Rimrock Strip (C-89-074), Status of Adequacy Issues Related to Ground <br />Water <br />I have reviewed the status of these topics following adequacy responses from <br />the applicant. Adequacy issues involving a hydrologic monitoring plan (Rule <br />2.05.6(3)(b)(iii), baseline ground water monitoring (2.04.7(1)), and sealing <br />of underground openings (2.05.4(2))9) have been resolved by submittals from <br />the applicant. I also feel that the baseline geologic and ground water <br />quality data is sufficient for the Division to assess the Probable Hydrologic <br />Consequences and Cumulative Hydrologic Impacts of the proposed operation. <br />The only question remaining concerns the EMD mine discharge. This appears not <br />to be a legally adjudicated water right, and an augmentation elan is therefore <br />not required of the applicant. In order to avoid the possibility of disputes <br />which could arise from its interruption, however, the applicant should be <br />advised of his option to obtain a well permit and valid water right from the <br />Colorado Division of Water Resources. <br />WBC/yjb <br />cc: Mike Savage <br />4864E <br />
