The mine is located on private lands within La Plata
County, Colorado. The legal description of the lands within the permit area
is: the NE 1/4 NE 1/4 and the NW 1/4 NE 1/4 of Section 31, T35N, R11W of the
New Mexico Principal Meridian, encompassing 53 acres.
This approval is based on a finding that the proposed operation will comply
with all requirements of the Colorado State Program as found in the Colorado
Surface Coal Mining Reclamation Act, C.R.S. as amended, 34-33-101 et seq., and
the Regulations promulgated pursuant to the Act.
If no requests for a formal hearing are made within thirty (30) days of the
issuance of this proposed decision, then this decision becomes final and, upon
submittal of an acceptable surety by the applicant, the permit will issue.
Upon permit issuance, the permit application will become a binding part of the
permi t.
-~-
