2) It is also possible that the quality of the AYF aquifer could be
impacted by drainage from the existing access/haul road which
currently crosses the AYF. However, it is thought that the
potential for significant degradation due this access/haul road
drainage is minimal. This is due to the high probability of
immediate dilution within the AVF, as discussed above.
Furthermore, the applicant has committed to berthing the
access/haul road which crosses the AVF in such a manner and of
sufficient size so as to prevent potentially poor quality
drainage from the road to drain onto the adjacent AVF. These
berms will be constructed as soon after permit issuance as
practicable and prior to removing coal from the site.
The-berms along the access/haul road, as well as the approved sediment control
system for the mine facilities area, will minimize the potential impacts to
the AYF. Furthermore, an analysis of data collected from the alluvial
monitoring well installed below the National King Coal, Inc., site indicates
that these measures are indeed sufficient to minimize impacts to the AVF.
Therefore, the Division makes the following findings:
Pursuant to Rule 2.06.8(5)(a)(i)(A)(1), the proposed operation
will not interrupt, discontinue or preclude farming on the
Alluvial Palley Floor;
Pursuant to Rule 2.06.8(5)(i)(A)(II), the proposed operation will
not materially damage the quantity or quality of the surface or
ground water systems which supply the Alluvial YaTley Floor;
Pursuant to Rule 4.24.2(1}, the proposed operation will be
conducted to preserve, throughout the mining and reclamation
process, the essential hydrologic functions of the Alluvial
Valley Floor both within and outside the affected area as
described in the permit application; and,
Pursuant to Rule 4.24.5, an environmental monitoring system is to
be installed, maintained and monitored so as to ensure that the
essential hydrologic functions and agricultural utility of the
AVF are not impacted.
The applicant is in compliance with the requirements of this section.
IX.
