The applicant has provided an identification of interests as required which <br />can be found in Section 2.03.4 - 2.03.12. <br />The applicant is in compliance with the requirements of this section. <br />II. Land Use - Rules 2.04.3, 2.05.5 and 4.16. <br />Historically, Hay Gulch and the surrounding uplands have been used primarily <br />for rangeland (i.e;; cattle grazing) and secondarily for use as wildlife <br />habitat. Information pertaining to land use can be found in Sections 2.04,3 <br />and 2,05.5 of the permit application. <br />Blue Flame is proposing to reclaim the disturbed area to rangeland with a <br />secondary post-mining land use of wildlife grazing. The Division finds that <br />the applicant is not proposing a change in the post-mining land use from the <br />identified pre-mining land use. The Division hereby approves the post-mining <br />land use of rangeland and wildlife habitat for the Blue Flame Coal Mine area <br />in accordance with Rule 2.07.6(2)(1). <br />The applicant is in compliance with the requirements of this section. <br />III. Cultural and Historic Resources - Rules 2.04.4 and 2.05.6(4). <br />The applicant has provided information on cultural and historic resources in <br />Section 2.04.4 of the permit application, This information is further <br />supplemented by information in the National King Coal, Inc., permit <br />application document. (The King Coal Mine (Permit C-81-035) is located <br />directly adjacent to the Blue Flame Coal Mine to the east.) <br />Contact with the State Historic Preservation Officer indicates that there are <br />no known cultural resources or resources listed on the National Register cf <br />Historic Places within the permit area. <br />The applicant is in compliance with the requirements of this section. <br />IV. Geology - Rules 2.04.5 and 2.D4.6. <br />Blue Flame has supplied geologic information pertaining to the proposed <br />operation and adjacent area. This information may be reviewed in Sections <br />2,04.5 an 2.04.6 of the permit application. <br />The proposed Blue Flame Coal Mine is located on the northwestern rim of the <br />San Juan Basin. The San Juan is an asymmetric structural basin in <br />southwestern Colorado and northwestern New Mexico. The basin contains <br />sedimentary rocks ranging in age from Cambrian to Holocene. The consolidated <br />strata exposed in and near Hay Gulch were deposited during the Upper <br />Cretaceous period by transgressing and regressing seas. <br />-7- <br />
