<br />other obligations required to be performed hereunder by Cyprus must be made or <br />performed. <br />3. Allowed Uses/Restrictions. <br />a. Cyprus, its employees, agents, licensees, invitees, contractors, subcontractors, successors <br />and assigns have the right and privilege to enter upon, through, under, over and across the <br />Lands, which, in Cyprus' sole discretion, may be necessary to support Cypnrs' activities <br />on the Lands for the purpose of: (I) surveying; (2) conducting base/ine environmen[al <br />studies as Cyprus may desire, including, but not limited to, vegetation and soil sampling <br />and mapping, surface hydrology investigation, cultural resources survey and mitigation <br />(jnecessary) and geologic reconnaissance and exploration activities; (3) construction <br />of a pad or pond jor an exploration borehole and drilling of an exploration borehole; <br />(4) utilize and upgrade an existing road into the drill site and construction of an <br />exploration road from the existing road into the drill site; (5) installation ojan electric <br />powerline; (6) removing and replacing existing drainage culverts, if any; (7) installing <br />subsidence monuments; (8) conducting seismic surveys; (9) construction and <br />maintenance of water monitoring wells; and (l0) general reclamation of dri!//bore hole <br />sites and other disturbed areas; and <br />b. Cyprus shall enclose all drilUbore holes with asheep-tight fence, and the gate for each <br />enclosed azea will be kept closed except when Cyprus personnel aze present at such <br />site(s); provided, however, that said fencing shall not be required around any drilUbore <br />hole which is located in an area or azeas which aze not being utilized for grazing purposes <br />by Surface Owner; <br />c. Cyprus shall salvage and stockpile topsoil from the borehole pad, the existing road and <br />the to be constructed explorntion road. All salvaged topsoil shall be placed adjacent to the <br />ventilation borehole pad and road(s); <br />d. Cyprus may place up to six inches (6") of gravel on the road(s) and ventilation borehole <br />pad. Cyprus shall, unless otherwise instructed by Surface Owner, remove the gravel from <br />the borehole pad and the road(s); <br />e. Cyprus at all times will frilly and promptly comply with all applicable laws, rules and <br />regulations of any goventmental authority which apply to its use of the Lands for the <br />hereinabove stated purposes; <br />f. Cyprus is hereby given the right of ingress and egress for itself, its employees, agents, <br />licensees, contractors, subcontractors, invitees, successors and assigns to and from the <br />Lands on or across the existing ranch or farm roads of Surface Owner connecting said <br />Lands to the nearest public road or roads including, but not limited to, the right to <br />transport on, over, across, under and through the Lands and such roads supplies, materials <br />and equipment necessary to support Cyprus' activities on the Lands; <br />~os~n.ootn~a - 2 - <br />
