<br />FROM THE UPSTREAM AREA OF THE REFUSE EMBANKMENT DURING THE <br />FOLLOWING PHASES; <br />1) AFT&R MINING OPERATIONS CEASE AND NO FURTHER WASTE IS <br />BEING DEPOSITED IN THE UPSTREAM AREA OF THE REFUSE <br />EMBANKMENT, THE UNDISTURBED DRAINAGE ABOVE THE WASTE WILL <br />NEED TO BE DIVERTED AWAY FROM THE SLURRY EMBANKMENT. A <br />METHOD OF DEWATERING THE SLURRY SHOULD ALSO BE ADDRESSED. <br />2) AFTER THE SLURRY HAS DEWATERED TO THE POINT WHERE <br />REGRADING ZS FEASIBLE, THE SUBSEQUENT RECLAMATION PHASE WILL <br />REQUIRE CONTAINMENT OF RUNOFF FROM THE SLOPES OF THE REFUSE <br />WITHIN A SEDIMENT POND. CONTROL OF RUNOFF WILL BE REQUIRED <br />UNTIL REVEGETATION SUCCESS CRITERIA ARE MET." <br />SKM Response: <br />Storm King Mines will comply with the requirements of Stipulation <br />No. 4 within six months of permit issuance. These revised <br />designs will become part of the permit application documents <br />prior to starting Phase "B" of development. <br />MLR Comment: <br />"Sedimentation Ponds <br />All runoff from disturbed areas will be routed through one of two <br />sediment ponds. One sediment pond is planned to be constructed <br />to drain the disturbed area of the surface facilities and one <br />sediment pond is planned to be constructed to drain the disturbed <br />area of the coal refuse impoundment. <br />Each sediment pond is designed to contain the runoff from a <br />10-year, 24-hour runoff event. The surface facilities sediment <br />pond (Pond A) is designed to contain one year of accumulated <br />sediment and the coal refuse embankment sediment pond (Pond B) is <br />designed to contain approximately 7 months accumulated sediment. <br />The applicant has committed to semi-annual sediment cleanout of <br />both sediment ponds, therefore the designs should be adequate. <br />Sediment Pond A and B are designed with emergency spillways <br />capable of passing the peak flow from a 25-year, 24-hour <br />precipitation event. Neither sediment pond is equipped with a <br />principal spillway. Instead, the applicant proposes to install a <br />pumping system to dewater the sediment ponds and use the water in <br />the hydraulic mining system. <br />The sediment pond below the refuse embankment is not designed <br />with a liner. Some type of lining is important since seepage <br />from the refuse embankment will likely be highly saline. The <br />
