i <br />SUBMIT TO THE DIVISION A PLAN FOR REPLACEMENT OF WATER IF <br />TAERE IS A CALL ON THE DOWNSTREAM COLORADO RIVER SYSTEM, SUCH <br />TAAT ANY APPLICABLE WATER DERIVED FROM THE DRAINAGE IMPOUNDED <br />BY THE REFUSE EMBANKMENT CAN BE RELEASED OR REPLACED. THE <br />APPLICANT MUST ALSO ADDRESS IMPACTS TO THE HYDROLOGIC <br />BALANCE IF SUCH AUGMENTATION IS NEEDED TO BE DERIVED FROM THE <br />REFUSE IMPOUNDMENT." <br />SRM Response: <br />Storm Ring Mines is currently working diligently on an <br />augmentation plan as part of its overall water rights program. <br />Storm King Mines will submit a plan to comply with stipulation <br />No. 6 within 12 months of permit issuance with subsequent <br />adjudication of water rights to be inserted into project <br />documents. <br />5) Ref: Alluvial Valley Floors - Rules 2.06.8 and 4.24 <br />MLR Comment: <br />Regyirement No. 3 <br />1) The applicant states that the downgradient wells, OW-8 <br />and OW-4L, should detect any degradation of water quality due <br />to the coal processing operation. The Division agrees with <br />this portion of the proposed monitoring plan for monitoring <br />the AVF below the surface facilities, but there is no mention <br />of a plan to monitor the effects of the coal refuse <br />embankment on the AVF downgradient from that structure. A <br />plan for monitoring any surface water and ground water <br />quality effects must be submitted. This plan must include <br />collection of one year baseline infocmation if applicable." <br />SKM Response: <br />Two monitoring wells, OW-9 and OW-11, are located downgradient of <br />the proposed coal refuse embankment and have been monitored since <br />July and October, 1983, respectively (See Table 3.3-1). Well <br />OW-9 is located below the proposed seepage collection pond and <br />OW-11 is located on the AVF, downstream of the proposed coal <br />refuse embankment (See Figure 3.3-12). <br />MLR Comment: <br />"2) The applicant's discussion of the significance of the <br />AVF area proposed to be disturbed only discusses the acreage <br />to be disturbed. In order for the Division to make a finding <br />concerning significance of the proposed area to be disturbed, <br />the applicant must provide an economic demonstration showing <br />
