Pursuant to 2.05,5(2)(c), a post-mining land use map must be provided. <br />2.05.6 Mitigation of the Zmpacts of Mining Operations <br />1. Air Pollution Control Plan <br />A. The applicant must provide documentation from the Colorado Department <br />of Health - Air Pollution Control Division of compliance with the provisions <br />of the Clean Air Act (page 78). <br />2. Fish and Wildlife Plan <br />A. The applicant must submit a detailed plan of how the operation will mini- <br />mize adverse impacts to fish and wildlife. This should include a more complete <br />statement of hoev the sediment facilities mitigate impacts and how revegetation <br />will enhance the wildlife habitat. <br />3. Protection of the Hydrologic Balance <br />A. Degreed springs not owned by Bear Coal Co. exist in the permit area and <br />adjacent area. The applicant must provide a description of how it plans to <br />ensure that the rights of the water users are protected (see Section 2.09.7(3)). <br />B. What measures are being used to ensure that the quality and quantity of <br />groundwater is maintained? <br />C. iJater Monitoring Plans <br />I) A surface water monitoring plan or a justification of why a monitoring <br />plan is not needed must be submitted. <br />2) Additional water quality parameters may be required in subsequent moni- <br />toring of groundwater and surface water. Attached as Appendix B is the <br />list of parameters requested by the Division. Exemptions from including <br />certain parameters may be allowed if the applicant can substantiate that <br />the particular parameter does not warrant testing. (See comments under <br />2.04,6(1)(b)(i).) <br />3) Will the monitoring wells that will be disturbed by the change in <br />Highway I33 be relocated? <br />D. The applicant must provide a determination of the probable hydrologic <br />consequences. <br />2.05.6 (6) Subsidence <br />1. The applicant must address the existence of renewable resource lands overlying <br />the mined area. Are any decreed springs in the permit area owned by parties other <br />than Bear Coal Company? <br />
