Gossett <br />Energy Fuels tdining Company <br />Suite 2500, 1200 17th Street <br />Denver, Colorado 80202 <br />Re: Draft Findings for Application to Renew Permit at Animas Mine <br />Dear Mr. Gossett: <br />Enclosed is a draft copy of the findings document which will accompany the <br />proposed decision to approve the Energy Fuels Mining Company (EFMC) <br />Application to renew the permit for the Animas Mine. There are four <br />stipulations included in the findings. As we indicated to you that we would <br />do, we are providing you with a draft copy in the event you are in a position <br />to satisfy any of the stipulations before the findings documents is <br />finalized. In such event, that stipulation could be removed from the final <br />document. <br />Please also note the requirement that EFMC increase reclamation bonding for <br />the Animas Mine to a total of E188,658.00 before approval of the renewal of <br />the permit becomes final. This figure was the estimated reclamation cost <br />included in the updated permit application. Your attention is also directed <br />to that portion of the findings document mentioning that a permit revision had <br />been required by September 10, 1987 to provide a new design for the northern <br />sediment control ditch associated with the processing waste pile. As you <br />perhaps recall, this revision was required in lieu of the Division issuing a <br />Notice of Violation for the excessive erosion occurring in the ditch. EFMC <br />should therefore, expedite their work on this revision and provide their <br />current best estimate of its submittal date. <br />Apart from the findings, the Division also requests that EFMC update <br />Sections 4.04 Support Facilities and 4.21 Coal Exploration Activities of the <br />permit application document to more accurately reflect current conditions. <br />The Division also recommends that revised pages for the permit application <br />document be provided for those containing incorrect affected and/or disturbed <br />acreage figures; ie. pp. viii, 18,346,483, and 516, <br />If you have any questions in regard to the above, please call. <br />Sincerely, <br />Ja,,ti>e, G S~~ <br />James C.
