Box 229 <br />Boulder, Colorado 80306 <br />RE: Bourg Coal Strip <br />Our Flle: s79-125 <br />Dear Margie: <br />This letter is In response to your request fora technical revision to the <br />above-referenced permit to change the name of the operator of the Bourg Mine <br />to Walden Coal Lo. <br />The change which you propose in not appropriate for a technical revision. I <br />see two possible courses of action open to Flatiron, which you should consider. <br />In order to make your decision, you should understand the distinction between <br />the terms "permittee" and "operator" as used by this Division. The permittee, <br />as might be expected, holds the permit and Is ultimately responsible for con- <br />pliance with the permit. The operator, on Lhe other hand, may be different <br />from the permittee and assumes no legal liability as far as this Divlslon Is <br />concerned. No official reeognitlon of the operator through this Division is <br />required. <br />Your choices are: <br />1. Take no action. The bond and permit sill remain In the name of <br />Flatiron Paving Co., and Flatiron will remain ultimately liable <br />for all reclamation. The mine ID sign must identify Flatiron as <br />permittee, although the name of the operator may appear as well. <br />This Divlslon does not need to be Involved In any way In Internal <br />agreements transferring responsibility for operating the mine to <br />Walden Coal Co. <br />T. Go through a Succession of Operators procedure, whereby Malden <br />Coal Lo. would submit a bond in theft name to replete the existing <br />bond, and would assume all responsibilities under the permit.
