Simpson, Assistant State Engineer ~~~ <br />SUBJECT: H-G Coal Company - Routt County, Application for Mining <br />and Reclamation Permit <br />As requested by your office, we have reviewed the application for a coal <br />mine operation near Hayden. The applicant, it appears, has adequately <br />addressed the potential water rights impacts associated with the proposed <br />mining operation. The applicant also furnished copies of a water right <br />application for Spring H-G-W and an application for a water storage right <br />for reservoirs RWD, HG-TH, HG-8, and the Hayden Gulch Mine Active <br />Pit Area. We have reviewed these applications and have the following <br />comments: <br />1 . Spring HG-W is located in the over-appropriated portion of <br />Dry Creek. In order to divert water from this spring, the r~ <br />applicant will have to develop a plan for augmentation which <br />has been approved by the Division Water Court. <br />2 . Reservoir HG-8. must have means of releasing any water that is <br />stored out of priority whenever a senior downstream right has <br />exercised his right to place a "call" on the river to obtain <br />sufficient water to meet his needs. The applicant could avoid <br />this imposition by developing an augmentation plan which must <br />then be approved by the Division Water Court. <br />If the applicant is unsuccessful in obtaining the water rights discussed above <br />because they have not developed a plan for augmentation, it would appear <br />that the applicant would not have sufficient water to meet their mining needs. <br />HDS/RLS:pkr <br />cc: Wesley Signs, Div.
