Dear Mr. Shelton:
The attached information and check in the amount of $705.00
should serve to satisfy the two deficiences noted in the
above-referenced CMLR letter.
The $705.00 filing fee was calculated persuant to Section
2.01.6 of Colorado Rules and Regulations for coal mining.
The total dollar figure is comprised of a $25.00 standard
fee plus $10.00 for each of the proposed 68 acres to be
affected (by definition).
The filing fee is, however, submitted by us over SEI objec-
tion, since a $530.00 fee was previously submitted for the
review of the application and not used for its intended
purpose. SEI should, with this resubmittal, be filing the
difference between the two amounts - $175.00.
The December 15, 1980 letter from the USDA constitutes a
negative declaration regarding prime farmlands, and as
noted in Section 4.1.2.4 of the application, is to be made
a part of the application through its incorporation as
Appendix L.
