Savage: <br />The Board of County Cuimnissiuners has forwarded your letter <br />of Janaury 9, 1985 to our office fur connnent. <br />The area of proposed mining operation is within a designated <br />minAra,l resource area ~f La Plata County and is subject to <br />the County's permitting requirements as adopted pursuant to <br />H.B. 1041. The previous operators of the mine (Arness & P1cGriffin) <br />obtained a County permit for the mining operations in February <br />1977. This permit was specifically issued for use only by the <br />applicants and may not be transferred. <br />Unless Peerless Resources, Inc. is in some way connected with <br />Arness and MMcGriffin, it would appear that a new permit would <br />be necessary before the operation would be in compliance with <br />the County's land use regulations.
