Exhibit K identifies numerous registered wells within, and in close proximity to, the <br />proposed permit boundary on the northwest, northeast, and southeast. Please submit a <br />table or permit text that details ownership of these wells, uses, and reference to location in <br />accordance with Rule 2.04.7(1)(a)(iv). <br />Northfield Response: Wells were tabulated in Exhibit K and permit text changed. <br />DRMS response: Well 248239 is improperly identified in Exhibit K regarding ownership. <br />The well belongs to Mr. Gary Zak. Change of address records were submitted and accepted <br />by the Division of Water Resources in November 2006 for this well. Please correct this <br />information. Other wells identified as possibly being affected by mining operations should <br />be reviewed for accuracy of ownership based on current records of the State Engineer's <br />Office. <br />Northfield Response: Figure 1 and Appendices 3 through 5 were updated with current <br />information. <br />DRMS Response: Response accepted. <br />13a. On page 2.04-20 it is stated that a review of well permits indicates that wells are <br />completed in alluvial deposits within the Chandler Creek drainage system. In <br />accordance with 2.04.7(]) please provide a description and characterization of the <br />alluvial groundwater to substantiate the claim (Page 2.04-16 Revised 5/01/07 last <br />paragraph, second sentence) that this unit is not an aquifer. Similar descriptions were <br />provided for all other formations of interest including the Yermejo, Raton, Poison <br />Canyon, and Ocean Wave Coal Seam on page 2.04-17 of the permit application. <br />Northfield Response: Additional information on existing alluvial wells was provided. <br />DRMS Response: Northfield provided well information and a discussion of the Chandler <br />Creek alluvium in the response letter but did not update the permit application package <br />(PAP) as requested. Please update Section 2.04.7 with the Chandler Creek alluvial <br />deposit description and available information. <br />13b. If it is determined that the alluvial groundwater system is an aquifer based on further <br />review and documentation as stated above in Item 13a, then provide a plan to the <br />Division for the design and installation of two additional groundwater monitoring wells <br />in the Chandler Creek alluvium. These should be located near the permit boundary in <br />close proximity to Chandler Creek at an upgradient and downgradient location. Please <br />also add these new wells to the Hydrologic monitoring plan in Exhibit AB. <br />Northfield Response: A new monitoring well will be constructed downgradient of the <br />mining operations along Chandler Creek. No well is proposed upgradient because we <br />believe the alluvium is not regionally saturated upgradient of the operation. <br />
