Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation, Mining, and Safety (Division) has completed the adequacy review of <br />materials received August 23, 2007 for the Northfield Mine permit application. Our original <br />question is highlighted in italics, followed by the Northfield response (pazaphrased) and the <br />Division's current response for each iteration. Where we still have remaining issues, I have bolded <br />text under the DBMS response. I have listed only those questions that were not resolved by your <br />last response. <br />Rule 2.03 Leaal, Financial, Compliance and Related Information <br />The Division has become aware of changes in land ownership since the application <br />materials were created. Please review county real estate records.for ownership changes <br />and make the necessary corrections to Map 1 and the permit text. Secondly, ownership of <br />the surface and coal is not clearly and accurately identified on Map 1, Land Use. The <br />permit text states that "unless otherwise noted, rights include both surface and minerals ". <br />In that case, the Zak parcel is to be mined yet they are not listed as mineral owners. <br />Finally, the permit text refers to coal ownership within the permit bounda~ on page 2.03-5 <br />but the Popkess-Vawter (Karki and Klavetter on Map 1) is not listed as a mineral owner. <br />Please review the requirements of Rule 2.03.4(6) and Rule 2.10.3(1)(a) and modify Map 1 <br />and the permit text to accurately, clearly, and distinctly depict the ownership of all coal to <br />be mined and the surface ownership within the permit boundary and adjacent to the permit <br />boundary. <br />Northfield Response: Edits were made to Map 1, permit text and Exhibit B (unlabeled}. <br />DRMS response: Changes to Map 1, Land Use were noted including the addition of surface <br />and coal rights as symbols in addition to structures within 1000 feet of the permit boundary <br />Office of Office of <br />Mined Land Reclamation Denver Grand junction Durango Active and Inactive Mines <br />
