The Division of Reclamation, Mining, and Safety (Division) has completed the adequacy review of
materials received August 23, 2007 for the Northfield Mine permit application. Our original
question is highlighted in italics, followed by the Northfield response (pazaphrased) and the
Division's current response for each iteration. Where we still have remaining issues, I have bolded
text under the DBMS response. I have listed only those questions that were not resolved by your
last response.
Rule 2.03 Leaal, Financial, Compliance and Related Information
The Division has become aware of changes in land ownership since the application
materials were created. Please review county real estate records.for ownership changes
and make the necessary corrections to Map 1 and the permit text. Secondly, ownership of
the surface and coal is not clearly and accurately identified on Map 1, Land Use. The
permit text states that "unless otherwise noted, rights include both surface and minerals ".
In that case, the Zak parcel is to be mined yet they are not listed as mineral owners.
Finally, the permit text refers to coal ownership within the permit bounda~ on page 2.03-5
but the Popkess-Vawter (Karki and Klavetter on Map 1) is not listed as a mineral owner.
Please review the requirements of Rule 2.03.4(6) and Rule 2.10.3(1)(a) and modify Map 1
and the permit text to accurately, clearly, and distinctly depict the ownership of all coal to
be mined and the surface ownership within the permit boundary and adjacent to the permit
boundary.
Northfield Response: Edits were made to Map 1, permit text and Exhibit B (unlabeled}.
DRMS response: Changes to Map 1, Land Use were noted including the addition of surface
and coal rights as symbols in addition to structures within 1000 feet of the permit boundary
