Long
Div isiun Durnor
' Dear Mr. Tift:
' The Division received Cottonwood Land Company's Notice of Intent
{X-96-219-00) to conduct coal exploration in our offices on January
30, 1996. Three determinations concerning the Notice have been
' made:
1) The Notice of Intent (NOI) was found to be incomplete.
t The following items need to be submitted in order for the
NOI to be called complete:
' a) Right-of-entry documentation is needed for
sites F and G. The Division will consider
stipulating this requirement if right-of-entry
documentation is not available at the time
' that the rest of the sites are approved for
drilling.
' b) Threatened and Endangered Species clearances
as required by Rule 2.02.2(2)(h) are needed
for the proposed exploration area. The
Division will consider stipulating this
requirement, if clearance is received for some
of the sites but is delayed for others.
However, the NoI will not be approved until at
' least one site has all the clearances needed
for drilling.
' 2) The project qualifies as coal exploration rather than as
coal mining.

II
