Stover & <br />Associates, representing Bowie Resources, Ltd. In this letter Mr. Stover responds to the <br />geotechnical adequacy questions contained in my two memoranda of January 14, 1997. <br />Subsequent to receipt of this letter, on January 28, 1997, I also participated in separate <br />telephone exchanges with James Stover and William Bear, Jr. In the case of Mr. Stover, <br />recorded messages were exchanged. Mr. Bear and I had a ten minute telephone conversation. <br />These telephone exchanges were initiated by Mr. Stover and Mr. Bear. <br />"Additional Stability Analyses, Proposed Portal Road Cuts and Topsoil Pile" (Memo #1) <br />(1) In his letter of January 21, 1997, Mr. Stover clarified his statement regarding commitment <br />to the various technical recommendations of MAXIM Technologies, Inc. <br />J. E. Stover & Associates has submitted a new Volume VII to the Bowie~No. 2 permit <br />application. Volume VII contains the various Geotechnical Studies prepared and <br />submitted to date in response to our original and supplemental adequacy comments. <br />Section 1 of Volume VII contains an Introduction, prepared by J. E. Stover and <br />Associates. In my earlier review memo I had commented that J. E. Stover and <br />Associates' summary statement appeared to selectively commit BRL to implementing only <br />a specific selection of MAXIM's geotechnical recommendations. Mr. Stover has amended <br />this document to clearly state;" BRL commits to implement all the recommendations <br />presented in the enclosed geotechnical studies prepared by MAXIM." This clarification <br />statement satisfies my earlier concern. <br />(2) In my January 14th memo I stated; "... the Division will need to require additional <br />procedural commitment from BRL. The Division attempts to be realistic about the <br />complexity of mine site construction situations. MAXIM, in completing its reports, has <br />
