S.-HER°~.5, Energy, Fuels Corporation desires to conduct a(n) strip mining
operation, known as ECY.MA~I PARK, ENERGY lE2 for the purpose of extracting strip
mined coal and '
WI1=_R)=~5, on September 27 1979 Energy Fuels Corporation "FIL~'+" an
applicat'_on,a reclamation plan and map, and the required fee, as required by 1acr; and
WHERE.~S, on January 29 , 19$0 the ;Lined Land Reclamatior. Board approved
Energy Fuels Corporation application and set bond; and
WHERE.~S, on March 24 19$0 the `fined Land Reclamation Board accepted
surely submitted by Energy Fuels Corporation and such date shall be considered the
date of issuance of the permit and the anniversary date for all other purposes; and
S:r.ERE.~S, the }fined Land Reclamation Eoard has made a finding, for the purposes
of issuing this permit, that:
1) the application complies with the requirements of the Colorado
}fined Land Reclamation pct and all applicable local, state and
Federal laws; and,
2) the operation will not adversely affect tae stability of any
significant, va'_uabla, and permanent man-made structures located
witain two hundred feet of tae affected land, except where there
is an agreement berreen the operator and the persons having ar.
interest in the structure that damage to the structure is to be
compensated for b;r the operator; and,
3) the proposed mining operations and reclamation can be carried out
is conformance with the reeuiraments of [he applicable Colorado
statutes governing the reclamation of mined lands.

satisfactory showing to the Board that he will employ during and after his
strip mining operations procedures reasonably desiened to mini-fire
as ouch as practicable the disruption from the strip mining operations
and will provide for the rehabilitztion of the affected land throueh the renz:cilitat_on
of plant cover, soil stabilic,, water resources, and other measures appropriate to tie
y subsequent beneficial use of such mined and reclaimed lands; znd that in the event
of the fai'_ure of his proposed reclamation plan, he will cake whatever measures •~aich
may be necessary in order to assure the success of reclamation of the lands affected
by his strip mining operations; and,
