Board approved <br />Energy Fuels Corporation application and set bond; and <br />WHERE.~S, on March 24 19$0 the `fined Land Reclamation Board accepted <br />surely submitted by Energy Fuels Corporation and such date shall be considered the <br />date of issuance of the permit and the anniversary date for all other purposes; and <br />S:r.ERE.~S, the }fined Land Reclamation Eoard has made a finding, for the purposes <br />of issuing this permit, that: <br />1) the application complies with the requirements of the Colorado <br />}fined Land Reclamation pct and all applicable local, state and <br />Federal laws; and, <br />2) the operation will not adversely affect tae stability of any <br />significant, va'_uabla, and permanent man-made structures located <br />witain two hundred feet of tae affected land, except where there <br />is an agreement berreen the operator and the persons having ar. <br />interest in the structure that damage to the structure is to be <br />compensated for b;r the operator; and, <br />3) the proposed mining operations and reclamation can be carried out <br />is conformance with the reeuiraments of [he applicable Colorado <br />statutes governing the reclamation of mined lands. <br />'dEER&~S, for the purposes of issuing this nerait, the operator has made z <br />satisfactory showing to the Board that he will employ during and after his <br />strip mining operations procedures reasonably desiened to mini-fire <br />as ouch as practicable the disruption from the strip mining operations <br />and will provide for the rehabilitztion of the affected land throueh the renz:cilitat_on <br />of plant cover, soil stabilic,, water resources, and other measures appropriate to tie <br />y subsequent beneficial use of such mined and reclaimed lands; znd that in the event <br />of the fai'_ure of his proposed reclamation plan, he will cake whatever measures •~aich <br />may be necessary in order to assure the success of reclamation of the lands affected <br />by his strip mining operations; and, <br />'..'F1ERE.aS, for the purposes of issuing this per~..it, a copy of tie applicat_on <br />approved be the `fined Land Reclamation Board of the State of Colorado is attacaed <br />to this permit and thereby becomes a part of the terns hereof. <br />NOId, THEREFORE, pursuant to the authority set forth in the Colorado )final <br />Land Reclamation let, article 32 of Title 34, C.R.S. 1973, as amended, (1916 <br />Sess.
