{ • • <br />PRELIMINARY ADEQUACY REVIEN <br />APEX N0. 2 MINE <br />Rule <br />2.03.3 Submissions of information and technical data on land use, <br />soils, geology, hydrology, vegetation, fish and wildlife, <br />climatology and cultural and historic resources must include <br />the names (and affiliation) of researchers, dates, and metholody <br />related to this information. <br />2.03.4 2 The R.L. The <br />OSM letter is not attached. <br />2.03.E C3)~ <br />2.03.8(2),(3)There is no schedule of the approximate time frame in which <br />each phase of the proposed operation will be developing (also <br />required by Rule 2.05.3(2)(b)}. <br />2.03.12 A copy of the newspaper advertisement of the application and <br />proof of publication of the advertisement must be filed with <br />MLRD. <br />2.04.3 The description of the pre-mining environmental resources within <br />the proposed permit boundary and the adjacent areas is inadequate. <br />The discussion of the area affected by surface operations and <br />facilities must be expanded to include the pre-mining capability <br />of the bottom lands along Oak Creek (Rule 2.04.3(2)(b)(i)~}. The <br />condition, capability, and productivity of vegetation in the <br />adjacent areas has not been addressed. A description of adja- <br />cent areas of similar character should adequately resolve these <br />issues. <br />A map and supporting narrative of the present land uses for the <br />permit and adjacent areas, prepared in accordance with Rule 2.10 <br />and the land use categories described in Rule 1.04(71), must be <br />supplied. Unless the applicant justifies an alternative definition, <br />the adjacent area may be assumed to include the area within 2 <br />miles of the proposed permit boundary. <br />The applicant must supply a description of the land use classifi- <br />cation under local law. <br />2.04.4 The documentation of cultural and historic resources has been <br />submitted to the State Historic Preservation Offices for a joint <br />review. Comments on this information will be forwarded to the <br />applicant as soon as possible. <br />
