Box 55 <br />Oak Creek, CO 80467 <br />Re: Preliminary Adequacy Review, Apex No. 2 Mine <br />Our File No. C-011-81 <br />Dear Mr. Canning: <br />The purpose of this letter is to convey to you certain preliminary concerns <br />which have been identified in the coordinated MLR-OSM review of your <br />application referenced above. This report constitutes the 60 day notification <br />of~preliminary findings as to the substantive adequacy of your application, <br />pursuant to CRS 1973, 34-33-118(5), as amended. I would like to stress <br />the preliminary nature of this report, as the review of your application can <br />not be completed without benefit of additional information. Additional <br />comments will be forthcoming as our review progresses on the issues raised <br />in this prelinimary report, and on other issues as they arise. <br />The hydrology and alluvial valley floor (AVF) investigation are of particular <br />concern due to the number of deficiencies discovered in the application, and <br />to time limitation under which revised investigations must be reviewed by <br />this office. I suggest that your response to these deficiencies be given a <br />very high priority. <br />All responses to deficiencies identified in this review, and any other revisions <br />or modifications you want to make to the permit application, must be submitted <br />as revisions to the existing application, not as additional submissions. In <br />order that the final permit document will remain as comprehensive and concise <br />as possible, all revisions should be prepared in a manner that will facilitate <br />their insertion substitution in the existing application; this must be done <br />for all 13 volumes (MLRD-5, OSM-7, County Clerk-1). <br />The permit review and decision-making process requires that the Division be <br />able to issue a written finding that the applicant has met all financial obli- <br />gations to the abandoned fund as required by Rule 2.07.6(2)(1); supportive <br />documentation is needed. <br />
