<br />-11- <br />Variance of Approximate Original Contour Restoration Requirements for Steep <br />S ope Mining - Rule 2.06.5 <br />The application does not contain a request for a variance from approximate <br />original contour restoration requirements for steep slope mining. Therefore, <br />this section is not applicable. <br />Maps and Plans -Rule 2.10 <br />1. Figure 4.2-2 should have the 5 year permit boundary delineated on it. <br />2. The applicant should submit maps which indicate mineral ownership. <br />3. The 5 year permit boundary is incorrectly delineated on Figures 3.3-11, <br />3.3-12, and 5.1-11. <br />4. A map should be submitted or an existing map revised to indicate the <br />proposed surface disturbance boundary, the 5 year permit boundary, the <br />affected area for the first 5 year permit, and the permit and affected area <br />boundaries for each successive 5 year permit term through the life of the mine. <br />5. Figure 4.2-19 indicates a boundary for surface facilities in Areas I and <br />II. This boundary is also indicated on Figure 4.2-3. The boundary as drawn <br />does not include the sediment pond for the load-out among other facilities. <br />The boundary must be revised and remapped to include all surface facilities <br />and then denoted as the surface disturbance boundary in the legend. <br />6. Figures 4.2-19, 4.2-20, 4.2-21, 4.2-22, 4.2-23, 4.2-24, 4.2-25, and <br />4.2-26 are all stamped "Preliminary". The Division cannot issue a decision <br />using preliminary maps. <br />7. The surface disturbance boundary should be indicated on Figure 5.1-2. <br />8. !s Mr. Sam S. Arentz a registered P.E. in Colorado. If so, his seal and <br />number should be added to his certification of Figures 3.1-4, 3.1-5, 3.3-6, <br />3.3-7, 4.1-3, 4.1-4, 4.1-5 (which must also be signed), 4.2-1, 4.2-2, 4.2-3, <br />4.2-4, 4.2-5, 4.2-6, 4.2-7, 4.2-8, and 4.2-27. <br />9. Several maps bear certification by someone other than a professional <br />engineer or professional geologist. According to Rule 2.10.3(2) this is not <br />acceptable. Therefore, Figures 2.1-1, 2.1-2, 2.1-3, 2.1-4, 3.1-1, 3.1-2, <br />3.1-3, 3.5-1, and 3.6-1 must be re-certified by a professional engineer or <br />professional geologist. <br />
