Dept. of q',~tural Pe~o!~rres In regard to your question ~:~hether H-G Coal Company has obtained the necessary approvals with respect to mining within 100 ft. of the outside right-of-::ay line of a public road we offer the following response. 1. On July 15, 1977 H-G Coal Company submitted a mining permit application to the Colorado Mined Land Reclamation Division. Ilithin this application H-G Coal Company presented its mining plans shoviing that mining would be within 100 ft of County Road ;t53. This permit was put on public review and was subsequently approved by the Colorado Mined Land Reclamation Board. 2. On September 27, 1977 11-G Coal Company received a special \ use permit fora surface coal mine from the Routt County Commissioners. Prior to approval, H-G Coal submitted a mining plan to the County showing that mining would be aiithin 100 ft of County Road X53. This plan was reviewed by the Routt County Commissioners at an advertised public hearing and also by the toxin of Hayden. There were no objections to mining within 100 't of the county road. 3. From February 5 - February 26, 1991 H-G Coal published a Legal Notice in the Steamboat Pilot for perniit renevial from the Colorado Mined Land Reclamation Division. In this notice H-G Coal Company indicated that it would be mining within 100 ft of the outside right-of- way of County Road X53.
