:. <br />.. -- -~ <br />III IIIIIIIIIIIIIIII <br />• <br />I~~I~~ERAL <br />RESOURCES <br />Af~D EiilGIl`~EERI~~G, I~IC. <br />Septemlxr 25, 1980 <br />Mr. Joe Sullivan <br />Chariman <br />Mined land Fn_clam~ti.on Board <br />423 Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br />Dear Mr. Sullivan: <br />This is a formal request on the behalf of Trinidad Basin Dlining, <br />Inc., to have the Board give an informal opinion as per rule 2.06.8(3)(a) <br />contained in Pegulations of the Colorado Ptined Land Reclamation <br />Board for Cazl Mining. Specifically, said opinion will be advisory <br />and will offer insight as to the status of the area to be affected in <br />regards to being in or adjacent to an alluvial valley floor. I would <br />further request that the Board advise the operator of the data the <br />Board will use in forming its opinion. <br />As you may know, the target date for sutmittal of an application <br />for the Colorado program is December 10, 1980. In response to this <br />requirement the operator is in the process of developing an application <br />for a mining permit under the new coal regulations and as such is <br />on a very stringent schedule as it attempts to prepare the permit <br />application. Therefore, I respectfully request that you direct the <br />appropriate members of the Mined Land Feclamation Division to provide <br />the Hoard with information necessary to render the informal opinion <br />as soon as possible. Although the regulations do not specifically <br />reference a field inspection of the site I would strongly recamiend <br />that such an inspection be conducted. If the Board or Division <br />determines a field inspection is to be carried out it would be <br />beneficial if the operator was extended an invitation to have his <br />representatives present during the inspection. A joint inspection of <br />the site would be beneficial in that it would allow for a rmre informal <br />trading of thoughts on the alluvial valley floor question. I strongly <br />suggest that an inspection, if one does occur, be carried out as <br />soon as possible as the field season is quickly drawing to a close. <br />P. O.
