Your recent request for compliance information concerning the above
referenced coal mining company was referred to my office for action. As there
was no response form attached to your request I hope this letter will suffice.
Presently, there are no coal mining companies operating in North Carolina
and there have not been any for over 30 years. There is, however, one
application for an exploration permit currently under review by OSM officials in
their Knoxville, Tennessee office. In 1983, OSM promulgated a Federal
Regulatory Program on coal mining in North Carolina due to an absence of such a
program. North Carolina elected not to retain primacy for this program;
therefore, the North Carolina Mining Act of 1971 is pre-empted and superceded by
the Federal Program.
