This letter will confirm the <br />discussion at our meeting regarding our concerns for initiating, as <br />soon as possible, facility relocation and actual mining in an area <br />directly adjacent to our present underground operations. <br />Participating in the meeting on October 2nd were the following <br />individuals: <br />David Shelton - MLRD Fred Banta - MLRD <br />Dan Mathews - MLRD William Bear - Bear Coal Company <br />Alan Czarnowsky - ACZ INC. J. Paul Storrs - Mining Consultant <br />The basic purpose of the meeting was to discuss the means by which <br />Bear Coal Company can continue mining in the area adjacent to existing <br />underground operations with no or minimal interruptions. <br />Unfortunately, Bear Coal Company has been forced to cut back employees <br />at the mine because the adjacent coal reserves are not currently <br />covered under the existing permit. These layoffs will continue as the <br />level of coal production decreases in the next few months. Bear Coal <br />Company has the immediate need to receive approval for relocating mine <br />facilities so that orderly operations can continue. <br />The following are the general items discussed during the meeting: <br />• Location of the Area Necessary to Continue Operations. <br />• Planned Mining and Reclamation Plans. <br />• Conversations with Mr. Don Crane of the Office of Surface <br />Mining. <br />• Necessity to Receive Prompt Approval of Permit Revision. <br />
